Compliance with State, Federal and Local Laws

POLICY

Believe Therapies, LLC and all personnel who provide services are in compliance with applicable federal, state and local laws governing healthcare building and fire safety codes.

PROCEDURE​

To ensure proper licensure of the clinic as well as all personnel who provide services for Believe Therapies, LLC, Believe Therapies will be defined as the following.

Believe Therapies, LLC is a rehabilitation agency that:

1. Provides a multidisciplinary program designed to upgrade the physical functioning of individuals are bringing specialized rehabilitation staff together to perform as a team; and

2. Provides occupational, physical, and speech-language pathology services.

Believe Therapies, LLC provides supervised and procedural guidance that is for the accomplishment of a function or activity; and

1. includes initial direction and periodic observation of the actual performance of the function or activity; and

2. Is furnished by a qualified person:

• Whose sphere of competence encompasses to particular function or activity; and

• Who (unless otherwise provided in this subpart) is on the premises if the person performing the function or activity does not meet the assistant level practitioner qualifications specified in 42 CFR §485.705(c).

Major Sources of Information

• Federal, State and Local laws governing health care’s building fire and safety codes will be located in the front office.

• Applicable state and local licenses and organization personnel records containing up-to-date information will be located in the front office.

• Written policies pertaining to communicable and reportable diseases conforming to applicable federal, state and local laws found in the Employee Handbook.

STANDARD SUBSECTION (A): Licensure of Clinic

POLICY

Believe Therapies, LLC will have the appropriate licenses required by state laws and center approval for meeting the standards established for licensure.

PROCEDURE

Believe Therapies, LLC will have copies of licensure to operate in Huntsville, Texas as required by occupancy of the premises and any other licenses or certificates as regulated by state or federal laws.

*NOTE: “Facility registration for Occupational Therapy Facilities and Physical Therapy Facilities will no longer be required [by the state of Texas] as of September 1, 2019, due to changes to the OT Practice Act and PT Practice Act that take effect that day.” (See Federal Register: June 14, 2019, Vol.44, No. 24).

STANDARD SUBSECTION (B): Licensure of Registration of Personnel

POLICY

Personnel that provide services for belief therapies, LLC are licensed, certified, or registered in accordance with applicable state and local laws. The clinic will maintain records of current licensure or registration of personnel available by the state of Texas. The personnel that are required to be licensed, but have failed to maintain active licensure, will be prohibited from client care until a current licensure has been reinstated and verified by the primary source agency.

PROCEDURE

All personnel will be licensed by the state of Texas as well as federal licensing entity as appropriate. The job description for each of the following roles note holding and maintaining license as a “qualification” in assuming the role.

• Occupational Therapist

• Occupational Therapist Assistant

• Physical Therapist

• Physical Therapist Assistant

• Speech-Language Pathologist

• Speech-Language Pathologist Intern

• Speech-Language Pathologist Assistant

Licenses will be verified at the time of hire by the Human Resources Department through each entity’s online license verification portal. Renewals will be tracked through Paylocity. Initial renewals and verifications will be maintained in the employee file in Paylocity.
